Please read these Terms of Service ("Terms") carefully before using the MAHA Action, Inc. Site ("Site") operated by MAHA Action, Inc. ("us," "we," "our"). Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site. By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site.
Conditions of Use
Your use of this Site is subject to the following conditions:
- You must be at least 18 years of age to use this Site
- You agree to use the Site in accordance with all applicable local, state, national and international laws and regulations
- You will not use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site
- You will not attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site
Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Site, to understand our practices regarding the collection, use, and disclosure of personal information. By using the Site, you agree to the collection and use of information in accordance with our Privacy Policy.
User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:
- Safeguarding the password and all activities that occur under your account
- Maintaining the accuracy of your account information
- Immediately notifying us of any unauthorized use of your account or any other breach of security
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
MAHA Membership
Provider. The MAHA Membership is presented and hosted by MAHA Action, Inc. on this Website. MAHA Holdings, Inc. ("MAHA Holdings"), a Delaware 501(c)(4) social welfare organization affiliated with but legally separate from MAHA Action, receives and retains all membership dues. Your membership is an agreement between you and MAHA Holdings.
Fees and Automatic Renewal. When you enroll, you authorize MAHA Action (on behalf of MAHA Holdings) and its payment processor to charge your selected payment method the applicable membership fee on a recurring basis, with dues transmitted to and retained by MAHA Holdings. Your membership automatically renews at the end of each term at the then-current rate until you cancel. The term, billing frequency, and amount are disclosed before you complete enrollment, and you must affirmatively agree to these automatic-renewal terms at that time. We will send any renewal reminders required by law.
Price Changes. MAHA Holdings may change membership fees upon notice to you before the change takes effect. The new fee applies to your next renewal term. If you do not agree, you may cancel before it takes effect.
Cancellation. You may cancel at any time through your account settings or by emailing support@mahamember.org, using a method at least as simple as the one used to enroll. To avoid being charged for the next term, you must cancel before that term's renewal date. Cancellation takes effect at the end of the then-current term, and you retain access through that date.
Refunds. Except as required by applicable law, membership dues are non-refundable. Cancellation stops future charges but does not entitle you to a refund of dues paid for the current term.
Benefits. Membership benefits are described at enrollment, are provided by MAHA Holdings and/or MAHA Action, and may be added, changed, or discontinued at any time; they have no cash value and are non-transferable. MAHA Holdings may suspend or terminate your membership for non-payment or breach of these Terms. MAHA Action and MAHA Holdings reserve the right to modify or revoke any guaranteed access or benefits described in these Terms at any time, with reasonable notice to affected members.
Tax Treatment. Membership dues are not charitable contributions and are not tax-deductible for federal income tax purposes. They are not political contributions to any candidate or committee.
No PAC Involvement. MAHA PAC, a separate political committee, has no role in the MAHA Membership program and does not appear in membership materials, payment flows, or solicitations. Donation links for contributions to MAHA Action are kept separate from membership enrollment links.
Application to MAHA Holdings. The Privacy Policy, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution provisions of these Terms apply to the MAHA Membership and extend to MAHA Holdings and its directors, officers, employees, and agents as though MAHA Holdings were named in those provisions.
Intellectual Property Rights
The Site and its original content, features, and functionality are and will remain the exclusive property of MAHA Action, Inc. and its licensors. The Site is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain any intellectual property rights that you may have in content that you submit, post, or display on or through the Site ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Site.
Prohibited Uses
You may not use this Site:
- For any unlawful purpose or to solicit others to engage in unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
- To spam, phish, pharm, pretext, spider, crawl, or scrape
- For any obscene or immoral purpose
- To interfere with or circumvent the security features of this Site
Disclaimer of Warranties
The information on this Site is provided on an "as is" basis. To the fullest extent permitted by law, MAHA Action, Inc.:
- Excludes all representations and warranties relating to this Site and its contents
- Does not warrant that the functions contained in this Site will be uninterrupted or error-free
- Does not warrant that defects will be corrected or that this Site or the server makes it available are free of viruses or other harmful components
Limitation of Liability
In no event shall MAHA Action, Inc., its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Site.
Indemnification
You agree to defend, indemnify, and hold harmless MAHA Action, Inc. and its affiliates, directors, officers, employees, agents, and third parties, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees).
Contributions
When you make a contribution to MAHA Action through this Site, you represent that the contribution is made from your own funds and that you are not a foreign national prohibited from making such contributions. Contributions to MAHA Action are not deductible as charitable contributions for federal income tax purposes. Payment card information is processed by our PCI-compliant third-party payment processor; we do not store full payment card numbers on our systems. Contributions are non-refundable except as required by law or where the contribution does not comply with applicable law. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Site will cease immediately. Termination of your Site account does not accelerate the cancellation of any active MAHA Membership, which is governed by the Membership section of these Terms.
Governing Law and dispute Resolution
These Terms shall be interpreted and governed by the laws of the District of Columbia, without regard to conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in Washington, D.C., in accordance with the Rules of the American Arbitration Association.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
No failure or delay by MAHA Action in exercising any right, power, or privilege under these Terms shall operate as a waiver of that right. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.
Entire Agreement
These Terms constitute the entire agreement between us regarding this Site and supersede and replace any prior agreements we might have between us regarding the Site.
